Why Does a Foreign Real Estate Investor Need an ITIN?
Three real-world events make the ITIN essential:
- Renting out the property. Rental income is reportable on Form 1040-NR. The investor needs an ITIN to file.
- Selling the property.FIRPTA withholds 15% of the gross sale price unless a Form 8288-B reduced withholding certificate is approved — which requires an ITIN.
- Deducting expenses. Property taxes, mortgage interest, depreciation, and operating expenses can offset rental income only when filed under a valid ITIN on Form 1040-NR.

How Does FIRPTA Withholding Work With an ITIN?
FIRPTA requires the US buyer (or the closing agent) to withhold 15% of the gross sale price when a foreign person sells US real estate. With an ITIN, the seller files Form 8288-B before closing to request a reduced withholding certificate based on actual capital gain — often dropping the withheld amount to a small fraction of the original 15%.
Without an ITIN, the 15% sits with the IRS and is only refunded after the seller files a complete Form 1040-NR for the year of sale, typically the following spring.
What Reason Code Does a Real Estate Investor Use on Form W-7?
- (b) Non-resident alien filing a US tax return. Most rental-income investors use this.
- (a) Tax treaty benefit. When claiming a reduced rate on rental income under a US tax treaty.
- (h) with Exception 4. When applying under the FIRPTA disposition path before a year-end return is due.
What Documents Does a Real Estate ITIN Application Require?
- Form W-7 with reason code (b), (a), or (h) checked
- Current passport (or two approved alternatives)
- Tax return (Form 1040-NR) OR exception document (closing statement, sale contract, withholding certificate request)
- For LLC-owned properties: EIN paperwork and operating agreement
When Should a Real Estate Investor Apply for the ITIN?
Apply at the same time the purchase contract is signed. The 7 to 11 week processing window means the ITIN is typically ready before the first rental period ends or the first sale closes.
