ITIN for TN Visa Holders: Canada and Mexico Professional Guide
What Is the TN Visa and Who Qualifies?
The TN visa is a US work category created under USMCA (formerly NAFTA) for Canadian and Mexican professionals in 60+ designated occupations such as engineers, accountants, scientists, lawyers, and registered nurses. Canadians apply directly at the border or airport (TN-1). Mexicans apply at a US consulate first (TN-2).
TN holders are work-authorized incident to status. The TN principal can apply for an SSN almost immediately. Their spouse and children enter on TD status, which is not work-authorized.
Why Do TN Holders Themselves Usually Not Need an ITIN?
The ITIN exists for individuals who must file US taxes but cannot get an SSN. Because TN-1 and TN-2 status both confer work authorization, SSA issues an SSN to the TN principal. The employer needs that SSN on Form W-2. The TN holder uses the SSN on all federal returns from that point forward.
The IRS rule is straightforward: an applicant must apply for the SSN first and be denied (or be clearly ineligible) before the ITIN path opens. TN holders pass the SSN test, so the ITIN does not apply to them.
When Do TD Spouses and Children Need an ITIN?
TD spouses cannot work in the US and are not SSN-eligible. If the TN family files jointly (which usually lowers federal tax liability), the spouse needs an ITIN to appear on the joint return. TD-status children claimed as dependents also need ITINs.
For per-line guidance, see the Form W-7 instructions and the broader ITIN for TN visa holders guide.
How Does a TD Family Member Apply for an ITIN?
- Pick the correct reason code on line 6.Most TD spouses use code "e" (spouse of a US person). TD children use code "d" (dependent).
- Attach the TN holder's federal tax return. Form 1040 with the TD spouse listed and dependent children named.
- Provide identity documents. A current Canadian or Mexican passport is the cleanest single document.
- Submit through a Certifying Acceptance Agent. A CAA verifies the passports locally so the family never mails originals to Austin.
What Tax Benefits Does the ITIN Unlock for TN Families?
- Married filing jointly status, usually saving several thousand dollars compared to married filing separately.
- Child Tax Credit for SSN-bearing children only under current law; the ITIN child receives the Credit for Other Dependents ($500).
- Higher education credits (American Opportunity, Lifetime Learning) for ITIN dependents in qualified programs.
- Itemized deductions and dependent exemptions calculated against the joint income, lowering effective rate.
How Long Does the Family ITIN Process Take?
The IRS quotes 7 to 11 weeks for standard ITIN processing. TN families filing in April should expect the longer end (9 to 13+ weeks) because peak season volume is heavy. Off-peak filings (June through December) usually finish in 7 to 9 weeks.
For full timing, see the processing time guide.
